The document analyses and describes the different initiatives, experiences and positions that MSF has had with regard to international investigations and judicial proceedings.

This Cahier du CRASH by Xavier Crombé combines a study of the experience and positions of MSF vis-à-vis occupation contexts since the 1980s, and the minutes of a talk organised by the 'Fondation MSF' in January 2006 on "Humanitarian action in situations of occupation". 

In September 2004, the Board of MSF-France decided to undertake a critique of the section’s operations in Darfur in 2003 and 2004. According to the terms of reference set by MSF-F president Jean-Hervé Bradol (see appendices), the aim was less to ‘evaluate’ our intervention than to subject it to a critical examination which would enable us to “identify our weaknesses and the ways in which they can be corrected.”

For nearly two decades, François Jean practiced humanitarian action based on a deep, pragmatic desire to understand, constant self-questioning, and broad intellectual curiosity. It will be clear to anyone reading his collected works, From Ethiopia to Chechnya: Reflections on Humanitarian Action, 1988-1999, that his writings resonate with dilemmas we face today.

Le pouvoir éthiopien aurait-il consciemment entravé la marche du système national de réponse aux crises pour produire une « urgence humanitaire » dans une zone périphérique et récupérer sous forme d’aide alimentaire le manque à gagner lié à la guerre et à la suspension des aides au développement ? Les bailleurs de fonds auraient-ils cautionné cette manipulation ? A vrai dire, le problème semble un peu plus complexe. La réalité se situe entre l’histoire sainte et la thèse de la machination scabreuse. C’est cette réalité compliquée que nous voudrions approcher, ce qui nous impose un détour préalable par l’économie alimentaire du pays et sa gestion politique.

L'aide humanitaire se déploie dans des contextes politiques et militaires complexes dont elle constitue une composante de plus en plus importante. Il suffit, pour s'en convaincre, de relever les multiples mécanismes d'instrumentalisation et d'appropriation auxquels les organismes d'aide sont confrontés en Somalie, en Bosnie, au Soudan, au Liberia.
